Of all the Bills that are on the table today, H.R. 450 the "Enumerated Powers Act" is by far the most urgent. While Washington DC is clamoring about Health Care and Wall Street, they are ignoring the fact that they have no power to legislate in these areas.
If we were to use ObamaCare and the Wall Street Reform Act as measures of urgent legislation, one might think that H.R. 450 must be 2500+ pages and requires a legion of lawyers to decipher it. However, this is not the case, the Enumerated Powers Act is only 1 page and requires the following;
(a) Constitutional Authority for This Act- This Act is enacted pursuant to the power granted Congress under article I, section 8, clause 18, of the United States Constitution and the power granted to each House of Congress under article I, section 5, clause 2, of the United States Constitution.
(b) Constitutional Authority Statement Required- Chapter 2 of title 1, United States Code, is amended by inserting after section 102 the following new section:
While this Act, in my humble opinion, does not go far enough in that it does not require previous Acts voted into Law to pass the same test, it will provide a resounding answer to Speaker Pelosi’s question "Are you kidding me?" when asked about the constitutionality of the Health Care Reform Act. The answer Speaker, is and will always be NO, we are not kidding you.
